Please read these Terms of Service carefully before using Everstory.

1. Introduction

Welcome to Everstory ("we," "us," "our"). These Terms of Service ("Terms") govern your access to and use of our platform located at geteverstory.com (the "Service"). By accessing or using the Service, you agree to be bound by these Terms.

If you do not agree to these Terms, you may not access or use the Service.

2. AI-Generated Content

Everstory offers optional AI-powered features that can generate content such as fiction novels, autobiographies, audiobooks, slideshows, and video compilations ("AI Features"). These features are only activated when you explicitly request them.

By choosing to use AI Features, you consent to your Content being processed by our third-party AI service providers for the purpose of generating your requested output. Your Content may also be used for our legitimate business purposes, including backups, service improvement, performance analysis, and ensuring the quality of AI Features.

  • Consent: AI Features are entirely optional. Your Content is only sent to AI service providers when you actively choose to use an AI Feature. You may use Everstory without ever using AI Features.
  • Content Generation: AI Features use your input stories to generate new creative works. Results may vary in quality and accuracy.
  • No Guarantee: We do not guarantee the quality, accuracy, or suitability of AI-generated content. You are responsible for reviewing all generated content before use.
  • Intellectual Property: You retain ownership of your original stories. AI-generated content based on your stories is provided for your personal use.
  • Third-Party Services: AI Features utilise third-party AI service providers. These providers have their own terms of service and privacy policies. By using AI Features, you acknowledge that your Content will be processed by these providers in accordance with their policies.
  • No Commercial Use: AI-generated content is for personal, non-commercial use only unless you have explicit written permission from Everstory.
  • Processing Time: AI features may take several minutes to generate. Processing times are not guaranteed.
  • Slideshow Music Copyright: If you upload your own music for use in slideshows, you represent and warrant that you own or have obtained all necessary rights, licenses, and permissions to use that music. Everstory is not responsible for any copyright infringement claims arising from music you upload. The royalty-free music tracks provided by Everstory are licensed for personal, non-commercial use within your slideshows only.

3. Age Requirement

You must be at least 18 years old to use Everstory.

By creating an account and using our Service, you represent and warrant that you are 18 years of age or older. We do not knowingly collect information from or permit registration by individuals under 18. If we become aware that a user is under 18, we will immediately terminate their account and delete all associated data.

4. Account Registration

To use certain features of the Service, you must create an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access
  • Be responsible for all activities under your account

5. Acceptable Use Policy

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree NOT to:

  • Use the Service in any way that violates applicable laws or regulations
  • Impersonate any person or entity or falsely represent your affiliation
  • Interfere with or disrupt the Service or servers/networks connected to the Service
  • Attempt to gain unauthorized access to any part of the Service
  • Use the Service to transmit viruses, malware, or other malicious code
  • Harass, abuse, or harm another person through the Service
  • Collect, store, or share the personal information of other people without their explicit consent
  • Collect, store, or share information relating to minors (persons under 18 years of age) without the explicit consent of their parents or legal guardians

6. Prohibited Content

The following types of content are strictly prohibited on Everstory and will result in immediate account termination and reporting to relevant authorities:

  • Child Sexual Abuse Material (CSAM): Any content depicting, promoting, or facilitating child exploitation or abuse
  • Illegal Content: Content that contravenes the laws of Australia or any other relevant jurisdiction (such as your country of residence). This includes, but is not limited to, material promoting terrorism, violence, human trafficking, drug trafficking, or other serious crimes
  • Defamatory Material: False statements intended to harm another person's reputation
  • Hate Speech: Content promoting violence or hatred against individuals based on race, ethnicity, religion, disability, gender, age, veteran status, or sexual orientation
  • Harassment or Threats: Content intended to harass, threaten, or intimidate others
  • Graphic Violence: Excessively violent or gory content without legitimate purpose
  • Pornography: Sexually explicit material or content depicting sexual acts
  • Spam or Malicious Content: Unsolicited advertising, phishing, or malware

Everstory cooperates fully with law enforcement. We will report illegal content and activities, including CSAM, to the Australian Federal Police (AFP), the Australian Centre to Counter Child Exploitation (ACCCE), and the eSafety Commissioner, as well as other appropriate authorities as required by law.

8. Subscription Plans & Payment

Free Trial

New users receive 10 free stories to explore the Service. After using your free stories, you must subscribe to continue creating content.

Paid Subscriptions

We offer various subscription tiers with different features and pricing. For current subscription options, features, and pricing, please visit our Pricing page.

Pricing and features are subject to change with 30 days notice to active subscribers.

Billing & Cancellation

  • Subscriptions are billed monthly in advance through our secure payment processor
  • You may cancel anytime; cancellation takes effect at the end of your current billing period
  • No refunds are provided for partial months or unused features
  • If payment fails, your subscription will be suspended until payment is resolved

9. Referral Program

Everstory may offer a referral program from time to time where you can earn rewards for inviting friends. If available, the referral program is subject to separate terms and conditions.

10. Content Ownership & License

Your Content

You retain all ownership rights to the content you create and upload to Everstory (your "Content"). We do not claim ownership of your stories, photos, videos, or audio recordings.

License to Everstory

By uploading or otherwise providing content ("Content") to Everstory, you grant Everstory a non-exclusive, worldwide, royalty-free license to store, process, reproduce, display, distribute, and otherwise use your Content as necessary to operate, maintain, and improve the Everstory service ("Service"), including but not limited to:

  • Displaying the Content to you and those you authorise;
  • Performing technical operations such as data backup, storage, and indexing;
  • Fulfilling legal obligations, including responding to lawful requests, court orders, or regulatory requirements;
  • Supporting legitimate business operations, such as analytics, troubleshooting, and service improvement.

This license remains in effect for as long as you maintain an account with Everstory. Upon account deletion, this license will continue solely for the limited purposes of:

  • Retaining backup copies for a reasonable period;
  • Complying with legal obligations;
  • Resolving disputes or enforcing our rights under applicable law.

Everstory will not share, sell, or use your Content for purposes unrelated to the Service without your explicit permission.

Content Responsibility

You are solely responsible for your Content. You represent that you own or have obtained all necessary rights, licenses, and permissions for any Content you upload, and that your Content does not violate any third-party rights (including intellectual property, privacy, or publicity rights).

Uploaded Documents & Copyright

When uploading documents (such as DOCX or PDF files) to Everstory, you warrant that all documents are either: (a) your own original work; (b) licensed to you with permission to upload and process them for the purposes of the Service; or (c) in the public domain. You must not upload copyrighted material that you do not own or have explicit permission to use. Violation of copyright laws may result in account termination and legal consequences.

11. Takedown Procedures

Reporting Violations

If you believe content on Everstory violates these Terms, infringes your rights, or is illegal, please report it through our Contact Support page or email abuse@geteverstory.com with:

  • Your contact information
  • A description of the violation or infringement
  • The location (URL or story ID) of the content
  • If claiming copyright infringement, proof of ownership or authorization

Our Response

We will investigate all reports as soon as reasonably practicable. For illegal content (especially CSAM), we will take action as required by Australian law, including content removal, account suspension, and reporting to authorities. For other violations, we may remove content, issue warnings, or terminate accounts as appropriate.

Content Removal

Everstory reserves the right to remove any content, suspend access, or terminate accounts without prior notice. Where content is removed or accounts are suspended, we may notify the affected user after the fact, subject to any legal obligations that may restrict such notification.

12. Limitation of Liability & Disclaimers

Australian Consumer Law

Everstory operates under Australian law. Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right or remedy conferred on you by the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other applicable law that cannot be excluded, restricted, or modified by agreement.

Service "As Is"

Subject to Australian Consumer Law, the Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

User Content Disclaimer

Everstory does not control, verify, or endorse user-generated content. We are not responsible for the accuracy, legality, or appropriateness of content uploaded by users. Users upload content at their own risk.

Limitation of Damages

To the maximum extent permitted by law (including Australian Consumer Law), Everstory shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, use, or goodwill, arising from your use or inability to use the Service, even if we have been advised of the possibility of such damages.

Our total liability to you for all claims arising from or related to the Service shall not exceed the amount you paid us in the 12 months prior to the event giving rise to liability, or one hundred Australian dollars ($AU100), whichever is greater.

Intellectual Property Warranty

You warrant that you own or have obtained all necessary rights, licenses, and permissions for any intellectual property contained in Content you upload, including but not limited to copyrights, trademarks, and other proprietary rights. You agree to indemnify, defend, and hold harmless Everstory and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with any claim that your Content infringes the intellectual property rights of any third party.

Third-Party Actions

We are not liable for any actions, claims, or damages resulting from your interactions with other users, your failure to obtain proper consents, or your violation of third-party rights. You agree to indemnify and hold Everstory harmless from any claims arising from your Content or your use of the Service.

13. Account Termination & Platform Hosting

Platform Hosting

Everstory is hosted on Base44 servers, which are located in the United States. By using Everstory, you acknowledge and consent to your data being stored and processed on servers in the USA. Base44's handling of your data is governed by their Terms of Service and Data Processing Agreement.

Termination by You

You may delete your account at any time through your Settings page. Upon deletion, your content will be removed from our active servers within 30 days.

Please note that your data may persist in our backup systems for up to 90 days following account deletion. Backups are maintained for disaster recovery purposes and are automatically purged in accordance with our retention schedule. During this period, backup data is not accessible for regular use and will not be restored except in the event of a system-wide recovery.

Termination by Us

We reserve the right to suspend or terminate your account immediately, without prior notice, if:

  • You violate these Terms
  • You upload Prohibited Content (as defined in Section 6 of these Terms)
  • Your account is used for illegal activities
  • Your payment method fails and you don't update it within 14 days
  • We determine (in our sole discretion) that continued access poses a risk to other users or the Service

Upon termination for violations, you forfeit all subscription fees paid and all content may be immediately deleted.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email and by posting a notice in the Service at least 30 days before the changes take effect. Your continued use of the Service after the changes become effective constitutes your acceptance of the revised Terms.

If you do not agree to the modified Terms, you must stop using the Service and may delete your account.
